Assault on caretaker: ASPF bats for FIR against NPP MLA Subir Marak

GUWAHATI, July 23: A’Chik State Peoples’ Front (ASPF) on Tuesday demanded the registration of an FIR against National Peoples Party (NPP) MLA from Rangsakona, Subir Marak for allegedly assaulting a caretaker of MBoSE guest house at Laitumkhrah in Shillong on July 16.

In a memorandum to the chief secretary, ASPF general secretary and lawyer Bernitha Marak said: “We express our grave concern over a disturbing incident involving MLA Subir Marak which occurred in the early hours of July 16 at 2 am at the MBOSE guest house in Laitumkrah, Shillong. As reported, Marak under the influence of alcohol and accompanied by his associates assaulted the caretaker of the guest house. It has also been reported that Marak brandished a firearm and threatened the caretaker due to a delay in opening the gate, despite the caretaker having just been woken up.”

“This incident is not only a serious breach of public order but also an egregious violation of several legal provisions. Given these grave allegations, we request that a criminal case be promptly registered against Marak and his associates. This should include
Section 187 of Bharatiya Nagarika Suraksha Sanhita, 2024,” the memorandum stated.

“This section addresses offences involving violence and threats against individuals. The reported assault and threats with firearms fall under this provision. A detailed investigation should be conducted and appropriate legal proceedings must be initiated,” it said.

The organization also abdicated for application of Section 27 of the Arms Act 1959 for unlawful possession and use of a firearm against the NPP MLA and urged the chief secretary to ensure the safety of individuals potentially at risk due to the conduct of Marak and his associates. This may include providing security to the caretaker and any other witness involved, the memorandum stated.

To maintain public trust and ensure transparency, a public statement should be issued outlining the steps being taken to address this incident and reassure the public that justice will be served, it also stated.

“We urge the concerned authorities to take swift and decisive action to address this serious matter. It is essential that all legal provisions are enforced to uphold the rule of law and ensure justice for the affected individual,” it added.

The copy of the memorandum was also submitted to the Meghalaya Chief Minister, Speaker of Meghalaya Legislative Assembly, deputy commissioner of West Garo Hills, Tura and superintendent of police, West Garo Hills.
