Shillong, Nov 9: The Khasi Hills Autonomous District Council (KHADC) on Monday recalled a Bill passed nine years ago for replacing it with the new KHAD (Administration of Elaka) (Second Amendment) Bill, 2021.
The Bill seeks to deal with matters with boundary disputes and creation of new villages within the jurisdiction of the Council.
“Accordingly, the KHAD (Administration of Elaka) (Second Amendment) Bill, 2012 is hereby recalled and “The KHAD (Administration of Elaka) (Second Amendment) Bill, 2021 survives/prevails,” Chief executive member Titosstar Well Chyne said in a report of the executive committee tabled during the session.
The Bill, 2012 passed on November 7, 2012 was returned by the District Council Affairs department on January 8, 2013 quoting the views and comments of the Law department which cited certain drafting deficiencies in the Amendment Bill.
Later, The KHAD (Administration of Elaka)(Second Amendment) Bill, 2021 was passed by the House on March 2, this year and the same has been forwarded to the secretary to the Governor of Meghalaya on March 10, with a copy to the DCA department.
Subsequently, the department on October 11 had sought clarification as to whether the Bill passed in 2021 survives for consideration or if it has been replaced by “The KHAD (Administration of Elaka) (Second Amendment) Bill, 2021”
Given the facts and circumstances, Chyne informed that the executive committee after scrutiny of the KHAD (Administration of Elaka) (Second Amendment) Bill, 2012 deems it necessary to recall and substitute the said Bill passed in 2012 with a new Bill namely “The KHAD (Administration of Elaka) (Second Amendment) Bill, 2021” which covers a holistic and broader perspective in the administration of Elaka in so far as dealing with matters with boundary disputes and creation of new villages is concerned.
