SHILLONG, Nov 4: The Khasi Hills Autonomous District Council (KHADC) on Thursday decided to write to the state government for coming up with a notification to ensure all tribal cases are tried in the district council courts.
Replying to a motion moved by Opposition leader PN Syiem during the Council’s winter session, chief executive member (CEM) Titosstarwell Chyne said, “The executive committee (EC) will again write to the District Council Affairs (DCA) department and the government to come up with a clear cut notification on cases related to tribal versus tribal.”
“The government has to come up with such a notification to avoid any confusion and to ensure that all tribal cases are trial by the district council courts,” he added.
Chyne said that the government in its earlier notification had clearly stated that the district council courts will continue to derive their powers from para 4 & 5 of the Sixth Schedule to the Constitution of India.
He said the KHADC had made its stand clear against the implementation of the CPC and CrPC in the whole state as this would dilute the powers of the district council courts.
Informing that the council would soon inaugurate the district council courts at Nongpoh and Mawkyrwat, Chyne said the objective is to further strengthen their powers. “We are also against any attempt to dilute the powers of the district council,” he added.
