Life Sentence for Dr. Sanjay Upreti’s Murderer: Justice Served After 29 Months

Gangtok, May 31: Dorji Thinley Bhutia, the prime accused in the murder of Dr Sanjay Upreti, was sentenced to life imprisonment by the District and Session Court, Gangtok.

Dr Sanjay Upreti, a Senior Cardiologist at Sir Thutob Namgyal Memorial Hospital, Gangtok, was murdered in broad daylight at the Hospital promised on December 14, 2021. He was stabbed by one Dorji Thinley Bhutia from Tathangchen, Gangtok when the accused Bhutia was trying to attack a female Hospital staff against whom he had a personal grudge. Dr Upreti had intervened in the attack on the hospital premises and, in the process, was stabbed. His leg had to be amputated, and attempts to revive him failed, leading to his death on December 24, 2021.

A case was registered in the District and Sessions Court at Gangtok, which, after 29 months of hearing, has passed the judgement. On Friday, murder convict Dorji Thinley Bhutia was sentenced to life imprisonment with additional fines. The accused was convicted by Sessions Court on Thursday.

District and Sessions Court, Special Division 1, Judge Jyoti Khadka pronounced the sentence to the convict under Indian Penal Code (IPC) sections 302 murder, 307 attempt to murder, and 353 threatens to use criminal force specifically to deter a public servant from performing their duty.

The convict has been sentenced to life imprisonment with a Rs 10,000 fine under IPC 302, ten years of imprisonment with a Rs. 1,000 fine under IPC 307 and one-year imprisonment under IPC 353.

Additional Public Prosecutor Yadhav Sharma addressed the media after the sentencing. He shared, “I prayed for imprisonment for life for 302 that too rigorous imprisonment and fine of Rs 50,000 and for 307 i prayed for ten years and fine of Rs 5,000 and for 353 i prayed for one year and fine of Rs 1,000”.

“I, as a Public Prosecutor, worked effectively and sincerely to the best of my knowledge, due to which I feel justice has been done to the case”, he said.

“He (convict) has a right to file an appeal before the Honorable High Court if he is not satisfied with the judgement passed by this Honourable Court”, said Sharma.
