SHILLONG, Sept 12: All the 30 MDCs of the Khasi Hills Autonomous District Council (KHADC) on Monday unanimously decided not to accept the notification approved by the state Cabinet for extending the provisions of the CrPC and CPC in the entire state.
KHADC chief Titosstarwell Chyne told reporters that the issue related to the ramification of the government notification was discussed during an all-party meeting attended by all members of the council.
“All the 30 MDCs have unanimously taken a clear decision not to accept the government notification,” he said.
He informed that the meeting has also resolved that a delegation of all 30 MDCs will meet the Chief Minister Conrad K Sangma as a follow up to the written representation submitted by council, requesting the government to include in the notification the words “excluding the courts created under the Sixth Schedule to the Constitution of India.”
Further, the KHADC has also decided to seek the intervention of the Governor Satya Pal Malik on the matter.
“We will also meet the Governor because there is a conflict between two authorities which are empowered by the Constitution of India. We are also empowered by the Constitution of India and similarly the decision taken by the state government is also based on constitutional provisions. Therefore, we have decided to apprise the Governor on the notification (for his necessary intervention),” Chyne said.
Meanwhile, the KHADC chief said that he would also soon call for a meeting with all the traditional chiefs, who are empowered to head the village courts across the region, to discuss and explain to them the implications that will arise from the implementation of the government’s notification.
When asked, Chyne said that the three autonomous district councils – KHADC, JHADC and GHADC – will also soon meet again to discuss and take a collective decision on the matter.
