Guwahati, Oct 13: After six years, Dulubi Bibi (50), who was declared an illegal migrant from Bangladesh, has been declared an Indian citizen based on circumstantial evidence.
In 2017, Dulubi Bibi Foreigners Tribunal in Silchar declared her an illegal migrant after her name was found to match multiple voters’ lists.
Dulubi Bibi expressed her happiness at proving her Indian citizenship.
“Today I am happy because I got my Indian Citizenship. After having Indian Citizenship, I was branded as Bangladeshi. My grandparents are Indian Citizen how I can branded as Bangladeshi. For two years I stayed in Silchar detention centre,” said Dulubi Bibi.
She said, “I am a Muslim woman and my family is conservative. I used to work as a cook before going to jail. I’m not sure my husband will accept me or I’ll get any works now. Will the government take responsibility of this damage,”.
Dulubi Bibi is a resident of Cachar district’s Udharbond area, and she was declared a foreigner by the member of Foreigners Tribunal-3 of Silchar on March 20, 2017 during a hearing of a 1998 case under the Illegal Migrants Determination by Tribunals Act (which was later re-registered under the Foreigners Tribunals Act in 2015).
After finding a mismatch in her name on the voter list, the tribunal ordered the police to arrest Dulubi Bibi and keep her under detention until she is pushed back to Bangladesh. Police arrested her on April 18, 2018 and pushed her to a detention camp in Silchar.
The court found that her name appeared as Dulubi Bibi, Dulabjan Begum, and Dulubi Bibi in different voters’ lists, and there were mismatches in her father’s and grandfather’s names in those voters’ lists. She also failed to establish a connection between her parents’ names.
She was released from the detention centre in April 2020 on bail following the direction of the Supreme Court, and in May 2023, she challenged the 2017 FT order in the Guwahati High Court.
She was declared Indian by the same member, BK Talukdar, who declared her an illegal migrant in 2017. Talukdar, in his order dated 7/10/2023, wrote that considering the facts and materials submitted and depositions in the earliest and present detailed of 1965, 1985, and 1997, along with the new documents of the 1993 and 2015 voter lists, they are to be appreciated without any doubt.
