Big relief for Rahul Gandhi in Modi Surname case: SC stays conviction of Cong leader in criminal defamation case

Delhi, Aug 4: In a major development in the criminal defamation case over ‘Modi surname’ remark, Supreme Court in an interim order stayed the conviction of Congress leader Rahul Gandhi on Friday.

While granting relief, SC said “no reason has been given by trial court judge for imposing maximum sentence, order of conviction needs to be stayed pending final adjudication.”

Supreme Court while granting relief said, “Not only was Gandhi’s right to continue in public life affected but also that of the electorate who elected him.”

SC said, “there is no doubt that utterances are not in good taste, person in public life is expected to exercise caution while making public speeches, says Supreme Court. As observed by this court while accepting his affidavit in the contempt petition, he (Rahul Gandhi) ought to have been more careful.”

Why was defamation case filed against Rahul Gandhi?

A criminal defamation case was filed against Congress leader Rahul Gandhi in 2019 by  former minister in the Gujarat government, Purnesh Modi.

The case was filed against Rahul Gandhi for his statement during an election rally in Karnataka’s Kolar on April 13, 2019, where he referred fugitive prominent businessmen who are wanted in India (Nirav Modi and Lalit Modi). He said “how all thieves have Modi as the common surname” remark.
