East Khasi Hills DC restricts use of loud speakers and PA systems to 10 PM

Shillong, Dec 23: The Deputy Commissioner of East Khasi District has prohibited the use of Loudspeakers/PA Systems/Music Systems for various events, celebrations, or festivities between 10:00 P.M. and 6:00 A.M. Under ‘no circumstances’ should there be any deviation from this permissible limit, a notification from the DC said.

“In view of repeated complaints received against the use of Loudspeaker / PA System / Music System for various events/celebrations/festivities, the Undersigned hereby issue the following general conditions for due compliance regarding the use of Loudspeaker / PA System / Music System…The organisers should ensure that Loudspeaker / PA System / Music System should not be used during the night hours between 10:00 P.M. and 6:00 A.M in compliance of the Order passed by the Honorable Supreme Court of India,” the notification from the DC states.

Urging organisers to adhere with the Supreme Court ruling it mentioned that the organisers should ensure that the order dated 18.7.2005 passed by the Supreme Court of India in C.A No. 3735 of 2005 (Arising out of SPL(C) No. 21851/2003) Forum, Prevention of Environment of Sound Pollution – Versus – Union of India and Others is strictly adhered to with regard to the use of P.A. System as well as playing of other musical instrument is concerned.

“The organizer(s) to maintain the ambient noise level within the prescribed limit of the Noise Pollution (Regulation and Control) Rules 2000 as amended ie (A) In Industrial area emission of sound level is 75 dB(A) Leq during day time and 70 during night time, (B) Commercial area, emission of sound level is 65 dB(A) Leq during day time and 55 during night time, (C) Residential area, emission of sound level is 55 dB(A) Leg during day time and 45 during night time and (D) Silence Zone, emission of sound level is 50 dB(A) Leq during day time and 40 during night time,” added the DC.

DC has also restricted organisers of any events/celebrations/festivities should ensure that the sound emitted from the Loudspeaker / PA System / Music System is confined to the vicinity of the specified area at all times and to strictly ensure that no disturbance is caused to the surrounding and nearby areas and the residents thereof.

Any untoward incident connected to the event/celebration/festivities leading to breach of peace and tranquillity will be the sole responsibility of the organizers) and will be liable for legal action as per law, it added.
