Shillong, Jul 13: The Meghalaya High Court has dismissed a petition seeking to quash an FIR lodged against four persons for allegedly assaulting and obstructing a police officer in Shella.
Chief Justice Revati Mohite Dere, on July 8, 2026, rejected Criminal Petition filed by Ajit Das alias Avinash Das, Ara Kumar Hajong, Iasuklang War alias Duh and Pradip Paul.
The petitioners had sought quashing of Shella PS Case No. 09/2026 registered under BNS Sections 115(1)(2), 132, 121(1) and 3(5), and the pending proceedings before the Judicial Magistrate, Sohra.
According to the FIR by Sub-Inspector Pradeep Thapa, he and his team went to Avinash Das’s limestone quarry after receiving information about a person being assaulted.
The FIR alleged that around 30-35 people were present and that petitioner No.1 obstructed and assaulted the officer while he was on duty, while the others continued assaulting the victim.
The petitioners cited a compromise agreement with the complainant and argued no offence was made out.
The court held that when a public servant is the complainant in a case involving obstruction of duty, he cannot consent to quashing.
On merits, the court noted witness statements, including those of police personnel on duty, corroborated that the petitioners had pushed the officer to prevent rescue of the victim.
Finding prima facie evidence of offences under Sections 132 and 121(1) BNS, the court dismissed the petition.
It said the trial court shall proceed on merits independently of the High Court’s observations.
