SHILLONG, MAR 10: Leader of Opposition Mukul Sangma has asked police to register a case against former MLA Estamur Mominin over a circulated video recorded on March 9, alleging it contained “vitriolic” rhetoric that could sow discord amid tensions over non‑tribal participation in GHADC elections.
In a first information report (FIR) filed at Phulbari police station on Tuesday, Sangma, who is also TMC leader, said the video showed Mominin addressing a gathering after he was allegedly assaulted at the West Garo Hills deputy commissioner’s office that day.
Sangma wrote that the speech, given when the former legislator went to file his nomination, “may have unwittingly or intentionally been given to provoke certain groups and promote disharmony amongst groups.”
The former chief minister added that the video named him and two others as having given “tacit approval” for Mominin’s nomination and for non‑tribal participation — something he denied.
He argued that as a public office holder, the claim could “incite feelings of hatred and probably commit offense by one community against another.”
“…towards the end of the speech in the said video the name of the undersigned aong with two other public figures have been taken as having given tacit approval for the filing of the nomination of the said Estamur Mominin thereby also implying the approval of non tribals to participate in the district council elections which is untrue as no such discussion had occurred nor approval given by the undersigned or any representative on the undersigned’s behalf. In the context of the social situation and the fact that the undersigned holds public office, the act prima facie inter alia amounts to rumours being spread which are likely to sow seeds of discord, incite feelings of hatred and probably commit offense by one community against another. Though from the available circulated video there is no unequivocal supporting photographs or video at the moment to suggest the size of the gathering, it is quite evident from the participating voices that the group is likely to have been a gathering larger than 10 individuals,” Sangma said while urging the police to act under Sections 192, 196, 353 and 57 of the Bharatiya Nyaya Sanhita or other provisions deemed appropriate.
