Victim forced to pay bribe by engineer writes to Meghalaya DGP seeking action

TURA, Oct 5: A Tura contractor who was forced to pay a bribe demanded by a engineer of PHE in North Garo Hills Bajengdoba has written to Meghalaya Director General of Police seeking action against the police officer in charge of that police station who has so far refused to register his FIR against the corruption even after more than two weeks.

The North Garo Hills police have allegedly been dragging its feet to register the case compelling the contractor to file a case in the Meghalaya High Court.

But, the officer in charge of Bajengdoba police station has continued to delay registering the FIR on the grounds that he needs to follow a process and obtain permission from the government even though such permissions are required only when it comes to arrest and not registering of a criminal complaint.

“On which provision of law under CrPC is the police officer refusing to register the case? There is no bar to police to register a criminal case and to investigate against any government officer and non-registering the FIR amounts to violation of criminal law,” says the contractor in his petition given to Meghalaya Director General of Police L R Bishnoi.

In his complaint letter to the DGP on October 4th, he mentions that as per Section 197 of the Code of Criminal Procedure of 1973 it is clear that the bar created by this provision is (i) against taking of cognizance by the court, and (ii) not against registration of a criminal case or investigation by the police agency or submission of a report by the police on completion of investigation, as contemplated by the provision of Section 173 of the code of 1973.

The continuing delay to register the FIR has put the North Garo Hills police in a bad light when it comes to registering and investigating crimes, particularly corruption allegations.
