Assam: Enquiry report finds gross illegalities in execution of de-siltation work in Guwahati

Guwahati, Jan 12: An enquiry has been conducted by Joint Commissioner, Guwahati Municipal Corporation (GMC), against alleged irregularities and illegalities in execution of de-siltation work in the Guwahati.

The Commissioner of GMC had detected some irregularities in execution of de-siltation work in Guwahati and ordered for an enquiry to find out the faults. The enquiry report was submitted to Commissioner, GMC.

The enquiry report made mentions about a firm, namely, M/S Dinsan Global Venture Pvt. Ltd. which was engaged for hiring of vehicles /machineries for carrying out the de-siltation of channels/drainage for the period from 02-04-2022 to 26-05-2022.

“The said firm submitted bills with forged weighbridge Slips for several crores of rupees and withdrew the government funds. The firm also submitted inflated bill to GMC showing supply of vehicles/machineries at inflated rates. The officers and staffs of GMC criminally conspired and did not implement de-siltation works as per terms and conditions laid down in the tender documents and payments were released to the contractors without proper execution of works based on forged weighbridge slips for their own pecuniary benefits and misappropriated Government funds meant for the developmental works of Guwahati city,” the enquiry report stated.

A FIR has also been lodged on the basis of findings of the preliminary enquiry conducted by the Chief Minister’s Special Vigilance Cell, Assam. The Vigilance Police Station Case No. 04/2022 U/S 120(B) /420/ 406/ 409/ 468/ 471 IPC, R/W Sec. 13(1)(a)/13(2) of P.C. Act, 1988 was registered on 21.10.2022.

“Upon completion of investigation of the case, sufficient documentary, material and circumstantial evidences were found to establish the criminal conspiracy and misconduct for committing misappropriation of government funds by the arrested accused persons,” a press release stated.

It further added, “On receipt of the prosecution sanction orders accorded against the public servants from the respective departments, the case is returned in Chargesheet vide Vigilance Police Station Chargesheet Number 01/2023 dated 11.01.2023 against the below mentioned accused persons for committing criminal misconduct during the period of their office which is in contravention with the laws laid down in the Prevention of Corruption Act 1988, (as amended in 2018), and under the provisions of the Indian Penal Code.”

The chargesheet has been submitted within record 82 days taking into consideration the enormous record analysis for the said period. The total number of pages in the chargesheet is 851.

However, the investigation is kept open U/S 173(8) CrPC for subsequent submission of supplementary chargesheet.
