Assam LoP writes to CJI over electoral roll revision row

Guwahati, Jan 29: Assam’s Leader of the Opposition ( LoP), Debabrata Saikia, has written to the Chief Justice of India seeking suo motu cognisance of what he alleges is the misuse of the Special Revision (SR) of electoral rolls and Form-7 in Assam, warning that the process threatens citizens’ statutory and constitutional right to vote.

In his letter, Saikia stated that the situation has moved beyond administrative lapses and has assumed the dimensions of a constitutional crisis.

“The situation has transcended the realm of administrative irregularity and has assumed the character of a constitutional crisis, where the right to vote under Article 326 of the Constitution of India is being systematically undermined through executive interference, communal targeting, and misuse of statutory procedures,” Saikia wrote.

He alleged that repeated media briefings and6 categorical public statements by Chief Minister Himanta Biswa Sarma indicate that notices under the Special Revision are being selectively served on a particular community — the “Miya” (Bengali-origin Muslim) population — with the stated intent to “keep them under pressure,” “make them suffer,” and demonstrate “resistance” in Assam.

Saikia further claimed that the Chief Minister has publicly stated that the government is “giving them trouble,” and that the issuance of such notices, eviction drives, and actions by border police form part of a conscious and continuing policy decision.

According to Saikia, these statements amount to an open admission that the Special Revision of electoral rolls and the use of Form-7 are being employed not for their lawful purpose, but as instruments of intimidation, harassment, and targeted disenfranchisement of a particular community.

“Such actions directly undermine the independence of the Election Commission of India, politicise the electoral process, and violate constitutional guarantees of equality, fraternity, secularism, and non-discrimination,” he said, adding that Form-7 — meant only for genuine and limited objections — has been turned into “a weapon of mass voter suppression.”

Saikia also pointed to public declarations allegedly made by the Chief Minister that only “Miyas” are being served notices, that the objective is to “make them suffer,” that “four to five lakh Miya votes will be cut,” and that the government is “trying to steal Miya votes,” calling these statements an unprecedented admission of intent to interfere with the electorate along communal lines.

Meanwhile, the Gauhati High Court on Wednesday (January 28, 2026) listed a Public Interest Litigation (PIL) seeking judicial intervention into the alleged large-scale misuse of objections during Assam’s Special Revision of electoral rolls, amid growing controversy over the Chief Minister’s remarks.

The court listing coincided with the Assam unit of the Trinamool Congress (TMC) issuing a statement objecting to the Chief Minister’s comments on alleged “vote theft” during the Special Revision process.
