Guwahati, Jan 23: The Supreme Court on Wednesday criticized the Assam government for failing to provide reasons for detaining 270 foreigners at the Matia transit camp in its affidavit.
The court had previously granted the state six weeks on December 9 to file the affidavit, expecting it to outline reasons for the detentions and detail steps taken for deportation.
A bench of Justices Abhay S. Oka and Nongmeikapam Kotiswar Singh expressed dissatisfaction, directing the Assam Chief Secretary to appear via video conferencing during the next hearing.

“The affidavit does not give any justification for detaining… steps taken to deport are not set out. This is a gross violation of this court’s orders. We direct the Chief Secretary to explain the non-compliance,” the bench observed.
The Assam government’s counsel argued that the detainees were declared foreigners by tribunals and explained the deportation mechanism for illegal migrants. However, the court was displeased when the counsel insisted the affidavit should remain confidential and sealed.
