Supreme Court reflects changing social realities

New Delhi, June 10: A recent Supreme Court ruling on premarital relationships is being seen as a wider recognition of changing social norms in India, with the court observing that authorities must be sensitive to evolving realities while assessing candidates for public employment.

The judgment came in a case involving a police recruitment candidate whose appointment was denied after officials treated a past consensual relationship as a reflection of poor character and “moral turpitude.”

Setting aside that view, the Supreme Court held that a consensual premarital relationship between two unmarried adults cannot, by itself, be considered a blemish on a person’s character.

The court noted that there is no law prohibiting such relationships and observed that not every relationship culminates in marriage. A failed relationship, it said, cannot automatically become a basis for questioning an individual’s integrity or suitability for public service

The bench further stressed that recruitment authorities must recognise changing social realities and avoid relying on outdated assumptions while evaluating candidates.

The ruling also addressed a broader issue. The court cautioned against treating the settlement of a criminal case as proof of wrongdoing and said decisions affecting employment should be based on objective facts rather than subjective moral judgments.

Legal observers say the judgment could have implications beyond the case itself, particularly in government recruitment processes where personal conduct is sometimes scrutinised despite the absence of proven misconduct.

At its core, the ruling reinforces a principle that courts have increasingly emphasised in recent years: personal choices made by consenting adults should not automatically become grounds for stigma, exclusion or loss of opportunity.

The judgment was delivered on June 8 by a bench of Justices Manmohan and Manoj Misra.
