Assam: SC seeks verification of documents in woman’s alleged deportation case

Guwahati, Jan 15: The Supreme Court of India on Wednesday issued notices to the Centre and the Assam government on a Muslim woman’s complaint alleging that she was being forcibly deported to Bangladesh despite producing documents to establish her Indian citizenship.

The petition was filed by Musstt Aheada Khatun after the Gauhati High Court on August 21, 2025, dismissed her plea challenging a September 12, 2019 order of a foreigners’ tribunal that declared her a “foreigner of post-1971 stream.”

Khatun was taken into custody on September 30 and is currently lodged at the Matia detention centre.

“Let notice be issued for the limited purpose of enquiring into the genuineness of the documents relied upon by the petitioner’s brother, who has filed an affidavit on her behalf, returnable on March 16, 2026,” a Bench comprising Justice Surya Kant and Justice Joymalya Bagchi said in its order after hearing senior advocate Chandra Uday Singh for the petitioner.

In her submission, Khatun said the case stemmed from “a long and unfortunate history of proceedings” beginning with a police reference allegedly made in 1998 on the basis of a report by an electoral registration officer, without notice to or participation of the petitioner.

She said the reference culminated in FT Case No. 72/2017, in which the tribunal held that she failed to establish linkage with her Indian parents and grandparents, “despite the production of nine admissible documents.”

Khatun further contended that the high court declined to interfere not on the merits of the case, but solely on the ground that she had failed to explain the delay in approaching the court.
