Tura, Mar 3: The A’chik State Peoples’ Front (ASPF), headquartered in Tura, has strongly condemned statement made by Ex MLA Esmatur Mominin and Ex MDC Sofior Rahman on the constitutional and statutory provisions governing the electoral process of the Garo Hills Autonomous District Council (GHADC).
In a statement issued by its General Secretary Bernita Marak, the organisation referred to recent video footage involving former MLA Mominin, alleging that he sought to question the legal framework regulating GHADC elections. ASPF termed the move as “constitutionally indefensible” and contrary to the spirit of the Sixth Schedule of the Constitution of India.
The organisation stated that the Sixth Schedule, enacted under Article 244(2), provides a distinct constitutional mechanism for autonomous governance in tribal areas of the Northeast. It emphasized that the powers granted to Autonomous District Councils, including authority over electoral rules, land, customary practices, and local administration — are protective safeguards intended to preserve tribal autonomy and self-governance.
Citing provisions under Paragraphs 2, 4 and 6 of the Sixth Schedule, ASPF maintained that the GHADC’s electoral structure forms an integral part of the constitutional framework designed to secure indigenous political representation. It argued that any public challenge to these provisions risks creating confusion and weakening protections granted to tribal communities.
The organisation further stated that grievances, if any, must be addressed through lawful and institutional channels, adding that the rule of law and constitutional supremacy must be upheld at all times.
ASPF called upon the competent authorities to take note of the matter and ensure that the constitutional provisions governing the GHADC remain protected in both letter and spirit.
