Guwahati, Sept 9: The Assam Cabinet on Tuesday approved the framing of a Standard Operating Procedure (SOP) under the Immigrants (Expulsion from Assam) Act, 1950, to empower district authorities to identify and expel illegal migrants from the state.
The move, aimed at tackling the issue of unabated illegal immigration from neighbouring countries, is being positioned by the government as a measure to safeguard Assam’s indigenous populace.
Key Features of the SOP
1.Identification: If District Commissioners (DCs) receive information from police or other sources about a suspected illegal immigrant, they will direct the individual to produce citizenship documents within 10 days.
2.Verification: If the evidence is found unsatisfactory, the DC will record the findings in writing and identify the person as an illegal immigrant.
3.Expulsion Orders: Once identified, the DC will pass an expulsion order under Section 2(a) of the 1950 Act, giving the person 24 hours to leave Assam through a specified route.
4.DFN Cases: Declared Foreign Nationals (DFNs), already identified by Foreigners’ Tribunals, will be expelled without further verification, since they have exhausted legal remedies.
Biometric Recording: Before expulsion, the migrant’s biometric and demographic details will be captured on the Foreigners Identification Portal.
5.Holding Centres & Push Back: If the individual fails to comply, the DC and SSP will place them in a Holding Centre or hand them over to the Border Guarding Force. Migrants detected near the zero line or within 12 hours of entry will be pushed back immediately without further process.
Other Cabinet Decisions
Alongside the SOP, the Cabinet also:
Approved ₹5 crore financial aid to Himachal Pradesh from the Chief Minister’s Relief Fund to support monsoon disaster relief.
Cleared correction of pay anomalies for 20 physiotherapists, speech therapists, accountants, and cashiers in medical institutions under the Health Department.
Approved an amendment to the Assam Agricultural Produce and Livestock Marketing (Promotion and Facilitation) Act, 2020, aligning it with the central Model Act, 2017, to enhance market access and ensure transparent, competitive bidding for farmers.
