TURA, March 5: The District Magistrate of West Garo Hills, has promulgated prohibitory orders under Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS) ahead of the 24-hour Non-Cooperation Movement (NCM) called by the Garo Students’ Union.
According to the order issued on Thursday, the agitation announced by the Garo Students Union (GSU) president Tengsak G. Momin is scheduled to be observed from 5:00 am on March 6 to 5:00 am on March 7 within the district.
The District Magistrate stated that the order was issued in view of the possibility of obstruction and intimidation that could disrupt normal life and public movement.
The administration also warned that such activities could lead to a breach of peace and disturbance of public tranquility, potentially resulting in injury, loss of property, or riots.
Exercising powers under Section 163 of BNSS, the District Magistrate has prohibited several activities during the period of the agitation. These include causing obstruction to the movement of vehicles, carrying or concealing weapons such as lathis, sticks, stones, missiles, firearms or any lethal weapons, obstructing the legal functioning of shops, establishments and offices and unlawful assembly of five or more persons aimed at causing such obstruction.
The order further noted that the Meghalaya High Court had earlier ruled that bandhs violate the fundamental rights of citizens guaranteed under Articles 19 and 21 of the Constitution.
However, the restrictions will not apply to armed forces, paramilitary personnel, or other law-enforcing agencies on lawful duty, the order clarified.
