Zubeen Garg death case: Motive and criminal conspiracy established, chargesheet submitted to court

Guwahati, Dec 12: Assam Chief Minister Himanta Biswa Sarma on Friday said that investigators have clearly established the motive and criminal conspiracy behind the case, following a detailed legal examination by the Advocate General and the Director General of Prosecution.

Speaking to reporters, Sarma said the prosecution team is confident of securing conviction based on the evidence gathered. “The motive and criminal conspiracy have been clearly tracked. After examination by the Advocate General and the Director General of Prosecution, everyone is convinced that this is a case where conviction is not only possible but highly likely,” he stated.

He confirmed that the chargesheet was filed on Friday before the Chief Judicial Magistrate, under Section 103 of the Bharatiya Nyaya Sanhita (BNS) along with other relevant provisions. “Some of the accused have been charged with murder, one with culpable homicide, and two PSOs with additional offences. The chargesheet runs into 12,000 pages, including the main document, seizure lists and witness statements. It has been a meticulously conducted exercise,” Sarma said.

The Chief Minister also clarified that while documents from Singapore were obtained during the investigation, the case does not depend on them. “We have proved the case with our independent documents. Even if the court decides the Singapore documents are inadmissible, the evidence collected in Assam alone is strong enough to establish the charges,” he added.

Calling it one of the most detailed investigations undertaken, Sarma said the government has full faith in the judicial process. “After prolonged investigation and effort, we have filed the chargesheet. We respect the judiciary for its independence and impartiality, and we are confident that justice will be delivered,” he said.

Outlining the next steps, Sarma said the government will request the Chief Justice of the Gauhati High Court to constitute a Fast-Track Court, and will appoint a Special Public Prosecutor for the case. “These steps will begin once the case is committed to the Sessions Judge and cognizance is taken,” he noted.
