Assam CM Himanta Biswa Sarma clarifies stand on second marriage of state govt employees

Guwahati, Oct 27: Assam chief minister Himanta Biswa Sarma on Friday clarified that the state government employees could not entitled to do second marriage.

Talking to media persons, Sarma said, “This is a old circular which is for Assam government employees. From the point of view of the service rule, he is not entitled to enter into second marriage. We have enforced the the law for the state government employees”.

“However If some religion allows to do the second marriage. Even though you have to take permission from the state government. The state government might give you or may not give you,” said Sarma.

He further added, “We have often get cases after the death of the employee both the wives fights for the pension. We find it very difficult to settle those issues. Today also many widows are deprived for pension because of the conflicting claims,”.

“The circular was earlier their but we have not enforce it but now we have enforced it,” he said.

The Assam government through a notification enforced ban on the second marriage for state government employees.

“It is hereby reiterated that as per the provisions of Rule 26 of The Assam Civil Services (Conduct) Rules 1965, No Government servant who has a wife living shall contract another marriage without first obtaining the permission of the Government, notwithstanding that such subsequent marriage is permissible under the personal law for the time being applicable to him,” the notification stated.

The notification was issued by Niraj Verma, Additional Chief secretary government of Assam, personnel Department.

“No female Government servant shall marry any person who has a wife living without first obtaining the permission of the Government,” the notification said.
